A judge dismissed the third-degree murder charge Thursday against former Minneapolis police officer Derek Chauvin in connection to the death of George Floyd in May.


hmm, this will confuse the public...will the Demoncrats tell their constituents to go riot, destroy and loot, or are we just too close to the election to fool with it?

I am surprised they did not wait until election night, that way it would get completely lost in the coverage of the shitshow.
 
Throwing out the lesser murder charge certainly doesn't seem like a victory for the defense...


May not matter. If 3rd degree murder is a lesser-included to 2nd degree and manslaughter in Minnesota, a jury could still find him guilty of that instead of the heavier charges, whether it's in the indictment or not. The defense can always argue that the prosecution has only proved the lesser-included offense. Sometimes prosecutors drop a less serious charge to try and force a jury's hand (that is, avoid a compromise verdict) on a more serious offense. Doesn't really work though if it is a lesser-included.
