While the federal bribery statute requires a quid pro quo, the illegal gratuity provision does not. Although this statute does not contain an attempt provision.

There is, however, a general conspiracy statute that could apply. For instance - if Kennedy reached out to the feebs based on an agreement he had with someone higher up the food chain in State, which is likely, it could be argued that he and that person had a criminal agreement to bribe the feebs with the proposed quid pro quo deal - the email being evidence of a substantial step taken by the conspirators towards achieving this agreement.

Just some food for thought.

The FBI in their statement stated that the FBI agent is the one who initiated the request for more agents to be placed in certain countries, not the State Department. Moron.
