Not remotely clear because the law was upheld when Truman argued (in 1946) that WWII was not completely over so he still had the right to deport Germans, Italians, and Japanese. 2.) Even with an established precedent, a Federal judge still has the right to ask for a review and order an injunction. Every American citizen should support this. It is a core foundation of our Democracy.
3.) I personally believe if you are here illegally, we should be able to deport you for no other reason at all. So rather than invoking an obscure 227 year old law, we should just deport you because you aren’t supposed to be here in the first place.
