More Cluelessness

Add to this a 95% budget cut to the Department that fights drug addiction.

herdman will say this is brilliant.

Then again, if Trump told him the sky was purple, he would think it was brilliant.

If West Virginia (& other states) are expected to pick up the tab, that means we'll be spending more on inmates than students.

Civics lesson:

The United States Attorney General (A.G.) is the head of the United States Department of Justice per 28 U.S.C.§ 503, concerned with legal affairs, and is the chief law enforcement officer and chief lawyer of the United States government.

Summary:

Sessions job is to enforce the laws and bring prosecution of those who violate federal law.

His job is not to run a social experiment.

He doesn't write law he is sworn to uphold them and enforce them.

Don't like the laws? Then, that is up to the legislative branch not the Attorney General.

A civics lesson more aligned with the issue:

Prosecutors, which include the A.G., have the independence and liberty to decide which charges they want to pursue in cases. In cases that have mandatory minimum sentences, prosecutors are able to not pursue charges if the mandatory sentence may not fit the reality of the crime.

The Attorney General of the USA are mainly after drug trafficking and distribution across state lines and the import of drugs across our borders along with gang activity. Let's not pretend they are after the local dope smoker or crack head. Those are handled by the states. He enforces federal law not state law.

I see you didn't keep up with much during the Obama years. Eric Holder, the former AG, directed prosecutors to do exactly what I mentioned. The article I linked isn't just going to be about how Sessions proceeds.

I have railed plenty against Holder for being the worst AG in my lifetime, which I still believe. But Sessions seems hellbent on taking the title. Rifle & I might not agree on a lot but he's right, Sessions isn't just going after the Heisenberg's, he channeling Nancy Reagan. The funny thing, his boss owns a number of hotels & restaurants. You have any idea how many of his employees do drugs & probably deal on the side? Sessions could literally cripple a large chunk of Trump's day to day businesses if that's where he wanted to start.

You really don't understand how federal drug charges work. Conspiracy is the main tool they use. Keep in mind almost every drug user will at some time do something to be charged with conspiracy. Share your crack with a friend for a few bucks? Conspiracy. Give your dealer a ride to Speedway and he passes drugs while there? Conspiracy. Hook someone up with your dealer? Conspiracy. At your dealer's home to buy and someone else is buying too? Conspiracy. Basically the feds, working with local police, just charge everyone with conspiracy to get everyone to snitch.

And here is the real bitch of conspiracy charges: every single person is charged with the totality of criminal activity of the main target. You bought two crack rocks and sold one to your friend, while your dealer was busted with a kilo of crack? You are charged with conspiracy to distribute a kilo of crack.

This is how the feds crack the bigger nut. You, the nobody crack head, will be charged with conspiracy. That's 20 years, at least. It could be life if your dealer was big time or if you have pervious drug convictions (and you probably do, because if you were busted earlier with two rocks in separate packaging the local court hit you with a felony but you only got a little time and probation, because state charges.) Now understand, what changed under Holder in 2013 is you, the crackhead, didn't plea to conspiracy, and the US Attorney ignored your previous piss-ant felony and didn't file for an enhancement. You snitched on who sold you a rock, and got more time than a state charge but way less than pre-2013. What Sessions wants is every piss-ant charged with major conspiracy, every previous conviction filed for enhancement. So now, instead of facing five and pleaded for two and a half, you are facing 20 to life, the enhancements are filed, and you are pleaded for 10 or 20. Want to go to trial? The feds have a 90% trial conviction rate. Enjoy life behind bars.

And this is all so easy to do because federal law does not require someone to be caught with an actual weight for the amount charges to stick. All that is required is someone to snitch and testify there was serious weight being moved. You better hope you are the first crackhead they pinched. He's the one saying "Yeah, that nigga sold a kilo." Everyone else is charged with conspiracy carrying a life sentence, because they are all piss-ant previous felons.

Holder knew the system was locking up nickel and dime sellers for long periods of time. All he ordered was for some common sense to be used. Sessions is throwing out common sense.

If you don't believe me, spend an hour or so on the net. There were tons of cases way overdone before Holder ordered some common sense. Were some of these folks bad people who luckily were locked up for something in reality much less than shit they could have been caught for? Sure. We get lucky sometimes. But a lot were just addicts that sold some of their stash to help pay for their addiction or habit. If I sell you two of my four rocks so I can smoke two rocks for five bucks cheaper, I need help for addiction, not 20 years in prison.

Also keep in mind there are very few places not under a federal drug task force. All that means is local cops have a couple of federal agents attached to them. So yeah, almost every bust that isn't the result of a simple traffic stop can go federal. That traffic stop possession charge? He tells the cop you sold him his dope, and that's your friend who you sold two of your four rocks to so you came out five less dollars down, yeah the local narc officer comes knocking with a Fed.

Listen: I want drug traffickers thrown under the jail. Unless weed. They are a scourge on our communities. But I don't want piss-ant addicts that split their stash jailed. I want them to get treatment. And I sure as hell don't want to pay for their 20 years in prison. I figure you feel the same. You are a smart guy with common sense.

And to be honest, yeah this is Sessions wanting to lock up every black ass possible. And white trash, because as Bob Byrd said, white n!ggers.

The funny thing, his boss owns a number of hotels & restaurants. You have any idea how many of his employees do drugs & probably deal on the side? Sessions could literally cripple a large chunk of Trump's day to day businesses if that's where he wanted to start.

Haha, that's true. Anyone that parties (or used to) knows you don't have to leave a fancy hotel to get drugs. Just ask the bartender ;)

Would like to see those statistics as to how many small or recreational users are imprisoned by the federal govt.

That might be impossible to know because of how conspiracy charges work. But if anecdotal evidence works for you, start paying attention to drug busts in your area. We recently had a federal task force warrant sweep, from the newspaper story it looked to me like 75% of the people were charged with just conspiracy.

Some state laws are no better. Here in Indiana meth carries huge sentences. Meth heads figure out how to one-pot enough meth for them and their buddies to get high for the weekend. They get caught with that two-litre bottle and get 10 years. WTF. These people are not Walter White. They are addicts. Basically Beavis and Butthead on meth.

The war on drugs has been a complete failure since its inception. Drug users are not going to stop using drugs because of stricter laws. Hell most users probably have no idea what their punishment would be for getting caught. We already put way too many folks in prison as it stands now. I've seen some studies from states that have legalized pot, and it appears that legalizing weed lowers the overdose rate of opiates. My opinion is WV should absolutely without a doubt legalize weed for recreational use.

This state is too ass backwards to do it. Hell, they found a way to legalize it for medical that wouldn't generate revenue.

Ain't that the truth! Leave it to WV to f*** it up !! Not only will it not generate revenue, but you gotta be filthy rich to even attempt to enter the industry.

Another non issue. Dope is just like guns, gays, God, abortions, stem cell research and welfare. It's here to stay like it or not.

But I like to see anybody stand up and paint it in a negative light.
