I read the same article. Ive also seen reports that the kid was asked to put it away and kept turning it on during another class and was causing a scene
Probably put the same kind of fight you do against providing your employees health care.
I've represented three kids that have been expelled (two of whom were arrested), all three were lower middle income white kids. The first had a pack of cigarettes which led to a search where a 1 1/2" pen knife was discovered in her pocket. Expelled under a zero tolerance policy.
The second a teacher brought up a school shooting in class. He knew remarkably specific information about school shootings (his mother was working on her master's thesis which was on the subject of school violence). They searched his locker and found a map of the school, arrested him and searched his home where they found a rifle (owned by his dead father).
The third brought a fake grenade to school and hid it in his locker. He told a kid that told on him. He was also arrested.
The idea that a kids brings something that clearly looks like a bomb to school would likely cause any administration acting under zero tolerance and high suspicion to not take a kids word for the fact that it isn't really a bomb. It also looks like a threat (which was the excuse used in my grenade case.)

Zero tolerance...fine. Expulsion is part of the process, but arrest does not have to be a part of it. Cell phones can be used to trigger explosives, do all cell phone users at school get arrested?
