Common sense has very little to do with law. Common sense is that plenty of people have no desire to abide by the rules we agreed upon, so the Court had to bullshit to keep the peace. And I'm cool with that.

If you go back to those times, which is supposedly the intent of Originalism, the Court in 1873 and 1883 was clear that the Enforcement Clause meant that if states chose to ignore the rest of the 14th, Congress would then step in to enforce it through "corrective legislation" (1883).

Colorado chose to not ignore it. There's no need for Congress to pass "corrective legislation".

Oddly, today's SCOTUS held that states can in fact keep an insurrectionist out of state office. But the framers of the 14th were clear they didn't want these folks in DC.

So much for Originalism. Or states' rights.

On a related note of states' rights, how far back does your WV ancestory go? If to the Civil War, which side did your ancestors pick? Them rich bastards across the mountains, or sticking with the Union and forming a new state?
