Second, the statute requires that the person doesn't know they are being photographed. This statute is about people secretly portraying (photo, video, etc.) another person who would reasonably expect privacy. Again, that was never the case.
That may be the case. Again, I don't know anything about these photos. If the person knowingly posed for the pics, the WV law would not apply.
In any event, since you don't live in WV or travel there, I doubt WV's law is the one you have to worry about. It's the state you were in where you uploaded the pics. And, be careful what you're relying on because, unlike WV, in many states it's NOT a defense that the person knew the pics were being taken.
