Your use of the term "statute" actually has no bearing on anything concerning BC's initial point as there are numerous theories of tort liability that could apply. Speaking of failing in reading comprehension. Probably because BC rattled you.

I then pointed out that your assertion concerning the applicability of criminal liability was wrong. It is. Again, many states have revenge porn statutes that would cover various stages of undress and/or expressly state that consent to having the photos taken is NOT a defense.

Now, if these photos were posted prior to the statutes being passed, you may have protection from criminal exposure. This depends on the specifics of the statute in the State you were in when you uploaded the pics. Again, all these things are unknown to me.

Finally, going back to civil liability - BC's initial point - the SOL on many actions doesn't begin to run until the victim/person harmed knew or should have known about the injury. There is obviously a lot of room to argue on this point, but it's probably going to be decided in favor of the plaintiff.
